2. DATES OF SWEEPSTAKES. Sweepstakes begins at 12:00:01am Eastern Time (“ET”) on July 24, 2024, and ends at 11:59:59pm ET on December 31, 2024 (the “Sweepstakes Period”).  During the Sweepstakes Period, gift card drawings (each a “Drawing”) will be conducted regularly, on an approximately biweekly basis, to randomly select a winner from all eligible gold entries (“Gold Drawing”) and a winner from all eligible silver entries (“Silver Drawing”).
3. ENTRY. Â Entries into each Drawing do not roll over from Drawing to Drawing. Â Limit one entry per person per Drawing.
Gold Drawing Entries: Â You can enter the biweekly Gold Drawing by: (1) achieving gold status on your Partner profile in the Shiftsmart App; or (2) sending a 3"x5" card with your name, address, telephone number, and email address to: Â Shiftsmart Gold Gift Card Sweepstakes, One World Trade Center, Suite 46L, New York, NY 10007. Â Such mail-in entries postmarked and received during the Sweepstakes Period will be entered into the next Gold Drawing after receipt. Â Shiftsmart reserves the right to determine at its sole and complete discretion when an individual has achieved gold status, such that an individual will be entered into a Gold Drawing. Once Shiftsmart has determined that an individual is eligible for a Gold Drawing, the individual will be given one entry in the next Gold Drawing. The pool for each Gold Drawing is made up of all such individuals as determined by Shiftsmart at its sole and complete discretion, and individuals cannot choose which Silver Drawing they are entered into.

Shiftsmart is not responsible for any type of technical difficulty (including, but not limited to: network server issues, connection problems, failed phone, computer, or telephone transmission, any type of technical failure), postal difficulty (including, but not limited to: late, lost, damaged, or postage-due mail), or any other type of error whether human, mechanical, or electronic. Any type of defective entry will be automatically disqualified. Shiftsmart reserves the right, in its sole discretion, to suspend or cancel the Drawings at any time.
4. ELIGIBILITY. Contest is open to United States residents and valid in all states, the District of Columbia and Puerto Rico except where prohibited or restricted by law. This Sweepstakes, and all promotions relating thereto, are subject to all federal, state, and local laws and regulations. Entrants must be at least eighteen years of age. By participating, entrant agrees to abide by these Official Rules and the decisions of Shiftsmart, which are final and binding in all respects.
5. DRAWING AND PRIZE. Drawings will be conducted regularly, on an approximately biweekly basis, in a time and manner to be selected by Shiftsmart at its sole and complete discretion. A single winner will be declared for each Drawing, based on which entrant’s name is selected at random. The winner of each Gold Drawing will receive a $250 electronic Visa® gift card. The winner of each Silver Drawing will receive a $100 electronic Visa® gift card.  The entrant selected must comply with all terms and conditions of these Official Rules, and winning is contingent upon fulfilling all requirements. The winner need not be present to win. The winner will be notified by text and email within seven days following the Drawing. Odds of winning depend upon number of eligible entries received. No cash substitutes allowed. The winner may not transfer the prize.
6. DELIVERY OF PRIZES.  Within two business days of notification, the winner must respond to Shiftsmart. By responding and agreeing to accept the prize, you are consenting to your name and other biographical information being published and identified as a winner. Failure to respond (or the return of any prize or prize notification as non-deliverable) may result in disqualification and forfeiture of any prize. In the event of a forfeiture, the prize will be awarded to an alternate winner.  Any tax liability incurred in connection with the receipt and/or use of the Visa® gift card is the sole responsibility of the recipient. Â
7. RELEASE. By receipt of any prize, winner agrees to release and hold harmless Shiftsmart and its officers, directors, employees, agents, and representatives from and against any claim or cause of action arising out of participation in the Sweepstakes or receipt or use of any prize. Each winner agrees, as a precondition for the receipt of any prize, to execute all releases and other documentation reasonably requested by Shiftsmart.
8. DISPUTES. Entrant agrees that: (1) any and all disputes, claims, and causes of action arising out of or connected with this Sweepstakes or any prizes awarded shall be resolved individually, without resort to any form of class action; (2) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Sweepstakes but in no event attorneys' fees; and (3) under no circumstances will entrant be permitted to obtain awards for and entrant hereby waives all rights to claim punitive, incidental, and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased.
9. VERIFICATION. The names of past winners may be obtained by sending a self-addressed, stamped envelope postmarked during the Sweepstakes Period, to Shiftsmart Gift Card Sweepstakes Winners List, One World Trade Center, Suite 46L, New York, NY 10007.
