‍

This privacy policy (“Privacy Policy”) discloses the practices of Shiftsmart, Inc. (“Shiftsmart,” “we,” or “us”) concerning information we obtain by and through your use of the Shiftsmart websites (including shiftsmart.com and shiftsmart.co) and the Shiftsmart Platform (collectively, the “Sites”), the Shiftsmart mobile apps (the “Apps”), or any other websites or apps that reference this Privacy Policy, and through other interactions and communications you have with us (collectively, the “Services”). This Privacy Policy applies to the Services and becomes effective as soon as you access or use the Sites or the Apps.

Introduction

Shiftsmart is committed to respecting your privacy and recognizing your need for appropriate protection and management of personal information you share with us. The purpose of this Privacy Policy is to explain the types of information Shiftsmart obtains about users of the Services, how the information is collected, how it is used, how it is disclosed, how you can get access to this information, and the choices you have regarding that information. Please review this Privacy Policy carefully.

What Information We Collect

Personal information means information about an identifiable individual. Shiftsmart may collect the following categories of personal information about you:

1. Information you provide

Shiftsmart collects information that you provide, such as when you create or update your Shiftsmart account (e.g., name, email address, phone number, date of birth, selfies/photographs/videos, government-issued identification documents, etc.); sign up to receive SMS messages; submit payment data (i.e., bank account/routing number); request services through the Apps or Sites; contact Shiftsmart, including for customer support; submit comments to Shiftsmart; subscribe to an email newsletter or email alerts; ratings and feedback; or participate in a survey, poll, blog, or live chat. Information may also be provided to Shiftsmart when you enable features that require Shiftsmart’s access to your address book or calendar.

2. Information created when you use our services

Shiftsmart collects information created when you use the Services, such as location, usage, and device information. Depending on the Services that you use, and your app settings or device permissions, Shiftsmart may collect your precise or approximate location as determined through data such as GPS, IP address, and WiFi. The App may be used without enabling Shiftsmart to collect location information. However, this may affect the functionality available on the App.

We collect transaction details related to your use of the Services, including the type of services you requested or provided, date and time the service was provided, amount charged, and other related transaction details. We collect information about how you interact with the Services, preferences expressed, and settings chosen. In some cases we do this through the use of cookies, pixel tags, and similar technologies that create and maintain unique identifiers. We may collect information about the devices you use to access the Services, including the hardware models, operating systems and versions, software, file names and versions, preferred languages, unique device identifiers, advertising identifiers, serial numbers, device motion information, and mobile network information.

Shiftsmart also tracks the activity and function of the Services in the form of log files on web servers. These logs are analyzed by third-party statistical analysis software solutions, such as Google Analytics, to provide visitor activity trend data. The information inside the log files includes IP addresses, browser type, Internet Service Provider (ISP), date/time stamp, referring/exit pages, App features or pages viewed, the number of clicks, App crashes, and other system activity.

3. Information from other sources

These may include:

  • Information from third parties, including insurance providers; financial services providers; publicly available sources; and marketing service providers.
  • Vendors who help us verify a user’s identity, background information, and eligibility to perform services, or who screen users in connection with sanctions, anti-money laundering, or know-your-customer requirements.
  • Law enforcement officials, public health officials, and other government authorities.
  • Shiftsmart business providers through which users create or access their Shiftsmart account, such as payment providers, or apps or websites that use Shiftsmart’s APIs or whose APIs Shiftsmart uses.
  • Users or others providing information in connection with claims or disputes.

Shiftsmart may combine the information collected from these sources with other information in its possession.

Identity Verification and Biometric Information

For certain users, Shiftsmart uses Checkr, Inc. and its service providers to verify identity and help prevent identity fraud. As part of our fraud-prevention measures, you may be asked to provide an image of a government-issued identification document and capture a live photograph or video of your face.

Shiftsmart and its service providers, including Checkr, may process the facial image or video to perform liveness detection, assess whether the identification document is authentic, extract or generate measurements or mathematical representations of facial features, and compare the live image with the photograph appearing on the identification document. Depending on applicable law, these measurements or representations may constitute biometric identifiers, biometric information, or sensitive personal information.

Shiftsmart uses identity-verification information to confirm that a person is who they claim to be, prevent impersonation and fraudulent accounts, protect the security and integrity of the Shiftsmart Platform, determine eligibility for projects requiring identity or background verification, and comply with applicable legal and contractual requirements.

Information processed in connection with identity verification may include your name, date of birth, government identification document and document number, document images, facial photographs or video, facial measurements or templates, liveness and verification results, device and network information, approximate location, fraud indicators, and information concerning unsuccessful or incomplete verification attempts.

Checkr and its authorized service providers process this information on Shiftsmart’s behalf. Shiftsmart may receive identifying information, verification results, status information, fraud indicators, and information necessary to investigate or resolve a verification issue.

Shiftsmart and its service providers do not sell, lease, trade, or otherwise profit from biometric identifiers or biometric information. Biometric information is not used for advertising, marketing, or unrelated profiling and will not be disclosed except to service providers assisting with identity verification and security, as authorized by the individual, or as permitted or required by law.

Biometric identifiers and biometric information are retained only for as long as reasonably necessary to complete identity verification, address fraud, security, legal, or dispute-related requirements, and satisfy applicable law. They are permanently destroyed in accordance with the applicable retention schedule when the original purpose for collecting or obtaining the information has been satisfied or within the period required by applicable law, whichever occurs first.

Before biometric information is collected, Shiftsmart or its service provider will provide any additional notice and obtain any express consent or written release required by applicable law. Where required by applicable law, a non-biometric identity-verification method will be available.  Consent may be withdrawn by contacting privacy@shiftsmart.com, subject to legal or contractual restrictions and reasonable notice. Withdrawal of consent does not invalidate lawful processing that occurred before the withdrawal but may affect eligibility for activities for which identity verification is legitimately required.

Shiftsmart performs the above activities for the identified purposes described in this Privacy Policy, where those purposes are reasonable in the circumstances and where Shiftsmart has obtained any consent required by law or may otherwise proceed without consent as permitted by law.

5. To Comply with Applicable Laws
